Terms of Service

Provider

Dark Forge Automation ("Dark Forge," "we," "us," or "our") is an owner-operated business providing the Services described in these Terms. Questions may be sent to DarkForgeAutomation@protonmail.com.

1. Agreement to These Terms

These Terms govern access to and use of Dark Forge Services. By affirmatively accepting an Order that incorporates these Terms, purchasing or activating a Service through an approved process, or using a Service after receiving legally sufficient notice of these Terms, a Customer agrees to the agreement documents applicable to that Service. Merely visiting a public informational page does not make a visitor a paying Customer or grant access to a paid Service.

A person ordering, configuring, or authorizing a Service represents that they have authority to act for the relevant Customer, Discord server, organization, account, or project.

Nothing in these Terms limits rights that cannot lawfully be limited.

2. Eligibility and Authority

Customers and Authorized Users must have legal capacity to agree to the applicable agreement, satisfy Discord's and other applicable platforms' eligibility requirements, and comply with applicable law.

A person configuring a Service for a Discord server, organization, bot application, repository, hosting environment, or third-party account must be authorized to administer or act for it. Users must not submit credentials, data, or delegated access they are not authorized to provide.

3. Definitions

  • Services means the public website, authenticated dashboards, portals, Discord bots, software, Custom Development Services, security tools, support, hosting, and related services actually provided by Dark Forge, including Foundry, StormVault, and Dark Forge website or dashboard interfaces.
  • Customer means the person or organization that orders, purchases, activates, or is responsible for a Service.
  • Authorized User means a person the Customer permits to access or use a Service.
  • Order means a Customer-specific Order, statement of work, Project Agreement, accepted contractual quote, written scope, plan selection, Discord purchase record, or another documented agreement accepted through an approved process.
  • Product-Specific Terms means an addendum, service schedule, or other terms expressly identified as governing a particular Service.
  • Custom Development Services means commissioned work in which Dark Forge is specifically engaged to build or customize something for a Customer. This may include custom Discord bots, commissioned Foundry implementations or customizations, dashboards, websites, customer portals, integrations, automation, and related custom software or development work.
  • Customer Data means content, identifiers, configurations, records, files, evidence, instructions, or other material supplied by or processed at the Customer's direction.
  • Customer Materials means Customer-owned logos, artwork, branding, text, content, data, and other materials supplied for a project.
  • Provider Materials means Dark Forge's pre-existing or reusable frameworks, libraries, infrastructure, utilities, templates, deployment tools, reusable components, generic systems, methods, know-how, independently developed components, and improvements.

4. Services Covered

Services may include:

  • Foundry: community management and automation for support, onboarding, moderation, engagement, roles, logging, and owner-facing controls;
  • StormVault: community security, reporting, cases, incident intelligence, threat protection, supported recovery, Safety Network features, and security dashboards;
  • Custom Development Services: commissioned bots, Foundry work, dashboards, websites, portals, integrations, automation, and related custom software; and
  • Websites, dashboards, and portals: public information, authenticated account access, product controls, support interfaces, and downloads.

Each Service is a separate offering. Access to one Service does not grant access to another unless an applicable agreement expressly says so. Ordinary access to Foundry, StormVault, or another managed product is not a Custom Development Service merely because Dark Forge develops that product. Separately commissioned customization may be a Custom Development Service.

5. Accounts and Authentication

Some Services require Discord authorization or authenticated dashboard access. Discord handles Discord account authentication, and Dark Forge does not request a user's Discord password through that authorization flow.

Customers and Authorized Users are responsible for protecting their accounts, maintaining accurate contact information, restricting administrator access, and reporting suspected unauthorized access. Configuration access may be limited to users with appropriate Discord permissions.

6. Acceptable Use

Customers and Authorized Users must use the Services lawfully, protect credentials, configure permissions responsibly, review security and recovery settings, and have authority to submit Customer Data, reports, evidence, and instructions.

Users must not knowingly:

  • fabricate reports or evidence, falsely identify innocent people, manufacture incidents, or manipulate safety workflows to harass or retaliate;
  • threaten, stalk, dox, target, or coordinate abuse against a person or community;
  • gain unauthorized access, steal credentials, bypass access controls, abuse OAuth or delegated access, or use prohibited self-bots or user-token automation;
  • create or distribute malware, credential stealers, ransomware, destructive payloads, spyware, botnet functions, or unauthorized remote control;
  • weaponize StormVault containment, snapshots, recovery, Safety Network, Anti-Raid, or Anti-Nuke features against innocent users or unauthorized servers;
  • impersonate Dark Forge, a Customer, an organization, or another person for a fraudulent, materially deceptive, or abusive purpose;
  • knowingly infringe intellectual-property rights, conduct unauthorized surveillance, disrupt systems, defeat rate limits, access another Customer's data, or interfere with authorization boundaries; or
  • use a Service to facilitate unlawful access, intentionally evade provider restrictions, or distribute malicious content.

Good-faith mistakes, incomplete information, honestly disputed interpretations, legitimate moderation, lawful reporting, authorized administration, good-faith security coordination, and authorized controlled testing are not automatically violations merely because another person disputes them.

Authorized interoperability, research, reverse engineering, or testing is not prohibited to the extent authorized by Dark Forge or protected by applicable law, but it must remain within its authorization and must not harm users, systems, or other Customers.

7. Third-Party Platform Dependencies

Discord and other third-party platforms are not controlled by Dark Forge. Their outages, policies, APIs, permissions, rate limits, account actions, catalogs, integrations, and technical changes may affect a Service. Dark Forge does not guarantee that a third party will maintain any feature, source, authorization method, identifier, or integration.

8. Product-Specific Provisions

8.1 Foundry

Foundry provides configurable community-management and automation features according to the selected plan, enabled modules, and any commissioned scope. Foundry should receive only permissions needed by enabled modules and must remain below protected staff roles where Discord hierarchy requires it.

Paid Foundry subscriptions are currently purchased and managed through Discord. Discord may handle checkout, renewal, cancellation, taxes, receipts, payment methods, and refunds under Discord's applicable terms and law.

8.2 StormVault

StormVault may provide reports, cases, appeals, evidence handling, incident intelligence, alerts, readiness information, containment, snapshots, recovery previews, selective restoration, Safety Network features, and security dashboards according to plan and configuration.

StormVault assists with detection, assessment, containment, coordination, snapshots, and supported recovery. It does not guarantee prevention or detection of every threat, prevention of data loss, or complete restoration. Discord limitations may prevent restoration of departed members, original Discord identifiers, deleted message history, or third-party bot authorizations. Recovery also depends on permissions, hierarchy, current platform state, and available snapshots.

8.3 Websites, Dashboards, and Portals

Public and authenticated interfaces may provide product information, account access, configuration, reports, support, downloads, and other Service functions. Access may depend on Discord authorization, server permissions, and connected-Service availability.

9. Custom Development Services

Unless a controlling Customer-specific written agreement states otherwise, the following framework applies to commissioned Custom Development Services.

9.1 Written Scope and Acceptance

Before development begins, the Customer will receive a written Order, statement of work, Project Agreement, contractual quote, scope document, or similar project document. It should ordinarily identify the Customer or project, approved scope, deliverables, price, payment schedule, included revisions, material dependencies, applicable support, material departures from these Terms, and incorporated Dark Forge policies.

The Customer must affirmatively accept the project document through an electronic signature, explicit written acceptance, an approved clickwrap or acceptance flow, or another documented affirmative method that is legally appropriate.

Payment alone does not universally constitute acceptance of unknown terms. If an Order clearly states before payment that payment accepts that specific Order, identifies incorporated Terms and policies, and provides a reasonable opportunity to review them, payment may serve as affirmative acceptance to the extent legally permitted.

Casual discussions, support messages, direct messages, and general inquiries are not automatically the complete final project agreement. Legitimate written commitments by authorized Dark Forge representatives are not disregarded, but final approved scope must be reasonably clear before work begins.

Material scope changes affecting price, deliverables, timeline, or major functionality will be documented and appropriately approved before changed paid work proceeds. Minor clarifications do not require a replacement agreement. Dark Forge may retain reasonable records of the Order, acceptance, and material approved changes.

9.2 Standard Payment

For a standard project that is not a qualifying Custom Bot Launch Offer project, 50% of the agreed price is due before development begins. The remaining 50% becomes due after the review and acceptance stage and must be received before final production launch, deployment, handoff, or completed-deliverable transfer, as appropriate.

Payment covers the approved scope. Material additions or changes may require a new quote, additional payment, or revised timing. Minor clarifications and correction of qualifying implementation defects are not automatically paid scope changes.

9.3 Revisions, Defects, and Scope Changes

Each standard Custom Development Service project and qualifying Custom Bot Launch Offer project includes two reasonable revision rounds unless a controlling Customer-specific agreement clearly states otherwise.

A revision round covers a reasonable set of related adjustments within the approved scope. New features, integrations, major redesigns, substantial architecture changes, replacement systems, or material functionality outside the scope are generally scope changes.

A defect exists when delivered functionality fails to materially perform as agreed in the approved scope. Correcting a qualifying implementation defect does not consume a revision round and is not automatically a paid feature. Unused revision rounds have no cash value, refund credit, transferable development-hour value, or indefinite future-feature value.

9.4 Review and Acceptance

After Dark Forge gives notice that a project is ready for review and testing, the Customer has seven calendar days to reasonably test it and report sufficiently clear implementation defects, material nonconformity, and requested included revisions. The Customer may expressly accept earlier and is not expected to identify a latent defect that ordinary testing would not reasonably reveal.

Where legally permitted, no response during the seven-day period may close the ordinary project-review stage and permit the project to progress. Silence does not waive nonwaivable rights, latent defects, documented unresolved defects, or every later claim.

For a standard 50%/50% project, the ordinary sequence is development, notice of readiness, seven-day review, appropriate handling of qualifying revisions and defects, acceptance, final-payment invoicing, receipt of final payment, production launch or handoff, and commencement of included launch support.

Acceptance does not transfer source-code ownership, Provider Materials, reusable intellectual property, or exclusivity beyond the rights expressly granted by the applicable agreement.

9.5 Customer Inactivity

Inactivity applies while Dark Forge is reasonably waiting for Customer action required to continue, such as scope decisions, materials, credentials, access, revision feedback, acceptance feedback, or deployment information. Silence alone does not start inactivity while Dark Forge can continue the agreed work.

After required action remains outstanding for 14 consecutive calendar days, Dark Forge may pause the project and remove it from the active schedule. After 30 consecutive calendar days, and after a reasonable contact attempt, Dark Forge may formally archive the project as inactive. A pause or archival is not automatic termination, deletion, fee, or forfeiture.

Resumption depends on scheduling, availability, technical feasibility, changed dependencies, and any material additional work caused by the delay. There is no automatic restart fee. Material additional work may require a disclosed new quote approved before it proceeds.

9.6 Credentials and Access

Dark Forge will request only access reasonably necessary for the agreed project. Where reasonably available, OAuth, scoped API keys, service accounts, delegated access, temporary credentials, collaborator access, and other limited methods are preferred.

Customers must not send personal Discord, email, banking, or payment-account passwords. Customers must have authority to provide credentials, repositories, hosting access, bot tokens, application secrets, and other access supplied for a project.

Dark Forge will use Customer-provided credentials only as reasonably needed, restrict access, avoid unnecessary duplication, not intentionally commit secrets to public repositories, and remove or revoke unnecessary access where practical. Customers should rotate temporary or shared credentials and remove unnecessary access after handoff. No security measure guarantees that credentials can never be exposed.

9.7 Working-Material Retention

Dark Forge may retain ordinary Customer-specific project working materials for 90 calendar days after project completion or formal inactive archival. After that period, Dark Forge may delete material it is not otherwise required or entitled to retain. This is a retention and cleanup policy, not a promise that every file will be deleted on an exact day or remain deployable for the full period.

The 90-day period does not convert Provider Materials into Customer-owned data, extend launch support, create permanent backup or hosting, or require deletion of lawful business records. Customer Materials remain Customer-owned. Credentials are not retained for 90 days merely because working materials may be retained and should be removed when no longer reasonably needed, subject to security and legal requirements.

Backups may retain deleted material until the applicable backup rotation completes. Limited project records may be retained longer for payment disputes, legal claims, security, fraud prevention, contractual duties, or law. This rule does not replace StormVault's separate security-record lifecycle.

10. Custom Bot Launch Offer

The Custom Bot Launch Offer applies only to qualifying custom bot development projects. It does not apply to websites, portals, dashboards, integrations, commissioned Foundry work, StormVault, Foundry subscriptions, or recurring subscriptions.

Approved one-time project prices are:

  • qualifying projects 1–10: $50 total;
  • qualifying projects 11–20: $75 total; and
  • qualifying projects 21–30: $100 total.

The offer is for new Customers only and is limited to one qualifying Launch Offer project per Customer. For this offer, a new Customer generally means a Customer that has not previously completed or purchased a qualifying Dark Forge custom-development project and has not previously used the offer.

A Customer may not intentionally split a larger project across identities or Orders solely to obtain multiple offer prices. This rule does not create a punitive fee or automatic forfeiture.

Dark Forge may reasonably determine qualification based on offer availability, approved scope, technical feasibility, project order, and compliance with the offer, subject to applicable law. Qualification and project order are confirmed during scope review.

Each qualifying project includes one custom-built Discord bot with four core bot systems, two reasonable revision rounds, seven calendar days for review and testing, and 14 days of launch support. After qualification and scope approval, the full offer price is due before development begins. There is no second 50% payment.

Optional hosting, maintenance, premium features, and add-ons are separate.

11. Subscription Plans and Billing

Subscription access may depend on an active entitlement, selected server, or support-confirmed status. Plan capabilities and limits are those shown in the current public plan description or applicable Order.

11.1 Foundry Plans

Foundry currently lists Free at $0 per month, Silver at $4.99 per Discord server per month, and Gold at $9.99 per Discord server per month. Paid Foundry subscriptions are currently managed through Discord.

11.2 StormVault Plans

StormVault currently lists:

  • Free: $0, one covered server, and one ordinary retained snapshot;
  • Silver: $9.99 per month, coverage for the subscribed Discord guild, and up to 10 ordinary retained snapshots;
  • Gold: $19.99 per month, coverage for the subscribed Discord guild, and up to 30 ordinary retained snapshots; and
  • Gold Plus: $24.99 per month, explicit coverage for up to three registered servers in one StormVault organization, and up to 30 ordinary retained snapshots per covered server.

Paid StormVault plans are monthly guild subscriptions purchased and managed through Discord. StormVault does not currently offer annual subscriptions. Discord may manage checkout, renewal, cancellation, receipts, taxes, localized pricing, payment methods, and refunds under Discord's terms and applicable law.

Support-priority indicators are not guaranteed response times, service-level agreements, or emergency-response promises.

11.3 Future Subscription Pricing

Dark Forge may change subscription prices prospectively. Current pricing is not guaranteed permanently, and permanent grandfathering is not promised.

Dark Forge intends to provide reasonable advance notice of a material increase before it applies at an applicable future renewal. A price increase does not change an already-paid period or authorize a prorated mid-period increase. Any notice period, renewal disclosure, consent, cancellation right, refund, or credit required by law or a controlling agreement remains applicable.

A Customer that does not wish to continue at a properly noticed new price may cancel, downgrade where available, or allow the subscription to end before the new renewal, subject to the applicable billing terms. A price change is not Service discontinuation and does not itself create a refund for a period already purchased and provided, except where law or a controlling agreement requires otherwise.

Dark Forge may expressly offer promotional, legacy, discounted, or grandfathered pricing without creating a general entitlement for every Customer.

12. Custom-Project Cancellations and Refunds

These custom-project rules do not create a refund right for a recurring subscription.

If a Customer cancels before development begins, development payments are generally refundable. Dark Forge may deduct only Customer-approved or properly disclosed project-specific costs that were actually incurred, are non-refundable or unrecoverable to Dark Forge, and may lawfully be deducted. No generic cancellation fee applies.

After development begins, payments are non-refundable only to the extent earned through work actually performed or applied to approved project-specific non-refundable costs. The entire initial payment or Launch Offer payment is not automatically forfeited merely because work started. Any refund must reasonably distinguish earned and unearned amounts, subject to applicable law.

Cancellation before the standard final 50% becomes due does not automatically make that remaining balance due. Separately approved work, milestones, or expenses already due remain subject to the applicable agreement.

After a project is accepted, fully paid, and delivered, deployed, or handed off, development payments are generally non-refundable, except for nonwaivable rights, unresolved material nonconformity, qualifying defect obligations, or another remedy required by the agreement or law.

If Dark Forge cannot complete a project for reasons not caused by the Customer, it will stop charging for unperformed work and refund the unearned portion. If completion is prevented by missing Customer access or materials, prohibited requirements, lack of authority, material breach, or other Customer-caused circumstances, treatment depends on work performed, approved costs, the agreement, applicable law, and the circumstances. Neither a full refund nor total forfeiture is automatic.

A legitimate defect report is not cancellation. Dark Forge will have a reasonable opportunity, where appropriate, to correct a qualifying defect before a refund remedy is considered, subject to applicable law.

Customer Materials may not be withheld as payment leverage. Cancellation does not automatically transfer unfinished work, source code, Provider Materials, or broader intellectual-property rights.

13. Third-Party Project Costs

Dark Forge is responsible for ordinary internal development tools, routine internal infrastructure, its ordinary development environment, and general overhead unless an Order expressly states otherwise.

A Customer may be responsible for approved project-specific external costs such as dedicated hosting, a domain, paid API, premium third-party service, external database or storage, project-specific license, or paid integration. Material Customer-responsible costs will be disclosed before they are incurred where reasonably possible and require Customer approval.

Where practical, the Customer should own and directly pay for Customer-specific third-party accounts. Recurring dependencies should be disclosed before adoption. Changes in third-party prices, APIs, limits, or availability may require a new quote for material redevelopment outside the approved scope.

14. StormVault Downgrades and Lifecycle

14.1 Ordinary Downgrade or Cancellation

An ordinary StormVault downgrade restricts premium capabilities but does not automatically erase legitimate historical security records. Existing cases, evidence, appeals, audit history, support messages, threat detections, containment history, authorized Network Incident history, and other records needed for security, integrity, disputes, or law remain subject to the Privacy Policy, approved retention, lawful deletion duties, and applicable law.

Existing evidence is not automatically deleted because a lower plan restricts new evidence. Premium configuration may be preserved where safe while premium-only execution becomes disabled or read-only. Automated premium actions may stop when entitlement ends; unsafe or destructive automation will not continue merely because a grace period exists.

Where the entitlement system applies downgrade grace, StormVault provides a seven-calendar-day grace period. Historical data and excess ordinary snapshots are not immediately purged solely because the lower plan has a smaller limit. New premium actions may be restricted during grace according to current product behavior. Grace does not promise unrestricted premium access.

After grace, eligible ordinary snapshots may be reduced to the applicable 1, 10, or 30-snapshot limit through normal retention, generally preferring the oldest eligible ordinary snapshots. Protected, incident, pre-restore, active-recovery, security-required, or audit-required snapshots are not automatically purged merely to meet an ordinary plan limit.

When a paid plan ends, a covered server may fall back to Free where current product policy permits. Downgrade is not immediate data deletion and is distinct from abuse termination, organization deletion, server deregistration, lawful deletion requests, and Service shutdown.

14.2 Server, Organization, and Safety Network Changes

Server deregistration may disable monitoring, automated protection, Safety Network participation, new snapshots and recovery operations, notifications, and operational dashboard functions after a safe transition. It does not automatically erase cases, evidence, audit history, threat records, Network Incident history, support records, or snapshots. Those records enter the applicable retention and deletion lifecycle.

Organization deletion must not indiscriminately erase another organization's records, shared Network Incident history, records required for security or audit integrity, legally retained material, or information affecting another community's rights. Organization-specific access may end while eligible contributions may be corrected or withdrawn through an authorized process.

When a community leaves the Safety Network, new participation and coordination actions stop after a safe transition. Authorized historical and audit records may remain under the Privacy Policy and applicable law. Departure does not allow one community to rewrite another community's private records.

14.3 Security Termination

Dark Forge may immediately restrict dangerous functionality or access where reasonably necessary to address serious prohibited use, abuse, fraud, credential compromise, unauthorized access, malicious use, or material threats. Immediate restriction does not authorize indiscriminate destruction of Customer Data or security records.

A termination caused by serious Customer misconduct does not automatically guarantee a prorated refund or credit and does not automatically forfeit all prepaid amounts. Treatment depends on Service provided, the controlling agreement, applicable law, and the circumstances.

14.4 Service Discontinuation

If Dark Forge permanently discontinues a paid StormVault Service or otherwise ends prepaid paid Service before the prepaid period expires for reasons not caused by Customer misconduct, Dark Forge will provide an appropriate prorated refund or Service credit corresponding reasonably to the unused prepaid portion, subject to applicable law, payment-provider capabilities, the controlling agreement, and legally permitted limitations.

The remedy need not always be cash rather than credit unless applicable law requires it. It does not automatically apply to voluntary cancellation, ordinary downgrade, or a future price change. A Customer may not receive duplicate refunds or credits for the same unused period.

If Dark Forge ceases operations and cannot provide already-prepaid paid Service, the same unused-value principle applies where legally and practically possible. Dark Forge does not guarantee recovery beyond its lawful and practical ability during insolvency, dissolution, or wind-down.

Permanent shutdown may end bots, dashboards, protection, Safety Network operations, snapshot creation, recovery, support, and hosting. Where reasonably practical, Dark Forge intends to provide reasonable advance notice and evaluate lawful, technically available data handling without promising an unsupported export feature.

15. Support

For a Custom Development Service that includes 14 days of launch support, including a qualifying Launch Offer project, the period begins when the completed project first enters intended production use or is formally handed over for production use, whichever occurs first. It does not begin merely when the project is presented for review.

Provider-caused pre-launch delay does not consume support time. Customer inactivity before production or handoff does not itself start support, but the Customer cannot postpone the start after production use or formal handoff has occurred.

Included support covers reasonable assistance with the delivered project, such as qualifying defect correction, deployment assistance, configuration help, and questions about delivered functionality. It does not include unlimited revisions or development, new features, major redesigns, new integrations, 24/7 support, guaranteed response times, or a service-level agreement.

16. Customer Data, Evidence, and Safety Network

Dark Forge processes Customer Data for purposes described in the Privacy Policy and as needed to provide, secure, support, and operate the Services.

People submitting reports, evidence, identifiers, or security records must reasonably believe they have authority or another lawful basis to submit the material. A good-faith report is not an absolute warranty of perfect ownership of every screenshot, message, or log. Incident intelligence supplies investigative context and does not automatically establish guilt or wrongdoing.

Safety Network participation is optional and may use anonymous or attributed coordination according to authorized settings. Private evidence, reporter information, cases, and internal staff notes are not automatically shared. Gold is required for active participation, while Free and Silver may receive privacy-safe safety warnings where current policy permits.

Authorized participants may raise good-faith concerns about inaccurate, outdated, misattributed, or improperly shared information. Dark Forge may review, correct, withdraw, or annotate eligible information while preserving an appropriate restricted audit history. A request does not permit one community to rewrite another community's private records or erase records that must lawfully remain.

17. Recovery and Backup Limitations

Snapshots and backups are operational tools, not guarantees against data loss. Availability depends on plan limits, timing, retention, Discord state, permissions, hierarchy, and API support.

Customers are responsible for reviewing recovery previews and known limitations before execution. Restoration may be selective or incomplete. Dark Forge does not promise unlimited storage, unlimited snapshots, exact deletion dates, or complete restoration.

18. Third-Party Services

Services may rely on Discord, infrastructure, backup, monitoring, email, support, media, API, payment, and other providers. Those providers may impose their own terms, licenses, limits, authorization requirements, outages, and changes. Dark Forge does not control their independent policies or availability.

19. Intellectual Property

19.1 Provider Materials

Dark Forge retains its rights in Provider Materials. Incorporating Provider Materials into a Customer project does not make them Customer-owned. Third-party and open-source components remain subject to their licenses.

19.2 Customer Materials

The Customer retains its rights in Customer Materials and grants Dark Forge the limited rights reasonably necessary to perform the applicable Order. Payment status does not permit Dark Forge to withhold Customer Materials as leverage.

19.3 Ordinary Custom-Development License

Unless a separate written agreement expressly provides otherwise, the Customer receives a perpetual, non-exclusive license to use the completed Custom Development Service deliverable for its intended project, website, portal, dashboard, integration, automation, community, or other approved purpose.

Ordinary project pricing does not transfer Provider Materials, source-code ownership, an intellectual-property assignment, independent maintenance rights beyond the ordinary license, or exclusivity. The Customer may not resell or sublicense Provider Materials on a standalone basis or represent them as independently created Customer intellectual property.

Dark Forge may reuse generic systems and functionality, build similar functionality for others, and maintain or improve reusable components.

19.4 Source Code, Buyout, and Exclusivity

Broader source-code transfer, ownership, buyout, independent-maintenance rights, or exclusivity requires a separately priced written agreement. Dark Forge retains Provider Materials unless that agreement expressly states otherwise.

20. Availability, Suspension, and Termination

Dark Forge will use commercially reasonable efforts to operate managed Services but does not guarantee uninterrupted availability. Maintenance, security work, third-party changes, outages, and events outside reasonable control may affect operation.

Subject to applicable law and the applicable agreement, Dark Forge may refuse Service or restrict, suspend, or terminate access for material breach, serious or repeated prohibited use, nonpayment, security risk, unlawful activity, knowingly false or malicious reporting, or platform-policy violations. Permanent termination is not automatic for every violation.

Dark Forge may take reasonably necessary protective action without ordinary advance notice when serious security abuse, credential compromise, malicious activity, unlawful access, or imminent harm creates a material risk. This does not authorize unnecessary destruction of Customer Data or eliminate legally required process or remedies.

Termination of one product does not automatically terminate every other Service unless the action expressly covers the broader Customer account or organization.

21. Disclaimers

To the maximum extent permitted by applicable law, the Services are provided "as is" and "as available." Dark Forge disclaims implied warranties to the extent they may lawfully be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Dark Forge does not control Discord or other third parties and does not guarantee uninterrupted Service, complete threat detection, prevention of every incident, complete containment, complete recovery, or prevention of data loss.

Nothing in these Terms excludes or limits warranties, remedies, or other rights that cannot lawfully be excluded or limited.

22. Limitation of Liability

To the maximum extent permitted by applicable law, Dark Forge is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from the Services.

This provision does not create a zero-dollar liability cap, does not exclude liability that cannot lawfully be excluded, and does not limit any nonwaivable Customer or consumer right. Any liability will be determined under the applicable agreement and applicable law.

23. Indemnification

To the extent permitted by applicable law, a Customer is responsible for third-party claims arising from Customer Data, Customer instructions, unlawful use, unauthorized server administration, submitted reports or evidence, or a material breach of these Terms, except to the extent caused by Dark Forge.

This provision does not impose obligations that cannot lawfully be imposed and remains subject to any procedure or limitation required by applicable law.

24. Applicable Law and Disputes

These Terms and disputes concerning them are governed and enforced subject to applicable law. These Terms do not designate an exclusive jurisdiction or venue.

Before beginning formal proceedings, the parties are encouraged, where appropriate, to contact each other and make a good-faith effort to understand and resolve the concern. This does not delay or waive a deadline, urgent remedy, nonwaivable right, or right to seek relief under applicable law.

These Terms do not require mandatory arbitration, waive class-action rights, waive jury-trial rights, require binding mediation, shift attorney fees, or select an exclusive court.

25. Changes to Terms

Dark Forge may update these Terms for legitimate Service, product, security, legal, regulatory, operational, pricing, billing-structure, or clarification reasons. Changes do not arbitrarily alter already-earned rights or fixed Customer-specific terms retroactively.

Non-material changes may be published with updated date information. For material changes, Dark Forge intends to provide reasonable advance notice where reasonably practical through one or more available website, dashboard, account, email, Discord, or ordinary Service channels. Any specific notice, consent, or cancellation requirement imposed by applicable law or a controlling agreement remains applicable.

Where legally permitted, continued use after revised Terms take effect may constitute acceptance. Continued use is not sufficient where law, the change, or an existing agreement requires affirmative consent. A Customer that does not agree may stop using or cancel the affected ongoing Service before the change takes effect, subject to existing obligations, earned fees, applicable cancellation policies, and nonwaivable law.

Security, fraud, abuse, legal, platform, provider, or material-harm changes may require faster action where advance notice is not practical. This is not an ordinary shortcut for a commercial price increase.

Current published Terms should identify their Effective Date and remain reasonably accessible without authentication. Dark Forge should preserve prior published versions through an appropriate legal-record process. A later version will not characterize completed conduct as a contractual violation retroactively when that conduct was permitted under the version applicable at the time.

26. Agreement Documents and Precedence

These Terms, applicable Product-Specific Terms, the Payment Policy, the Privacy Policy, and any applicable Order should be read together.

If applicable commercial documents irreconcilably conflict on the same subject, the following order controls only to the extent of that conflict:

  1. a Customer-specific signed or otherwise affirmatively accepted Order, statement of work, Project Agreement, or other written agreement that clearly controls the subject;
  2. applicable Product-Specific Terms;
  3. the Payment Policy for payment, refund, cancellation, and billing mechanics; and
  4. these Terms.

A higher-priority document does not replace a lower-priority document as a whole. An override is limited to the subject clearly modified. Mandatory law, nonwaivable rights, and data-protection obligations always remain applicable.

The Privacy Policy separately governs personal-information handling and is not silently overridden by a quote, invoice, casual message, or general project discussion.

27. General Terms and Contact

Neither party may assign an applicable agreement except with consent or in connection with a merger, acquisition, business transfer, or sale of substantially all relevant assets, subject to applicable law and the controlling agreement. If Dark Forge later forms or transfers operations to another entity, provider identity and applicable agreements may be updated through a lawful Terms-change or agreement process.

If a provision is unenforceable, the remainder remains effective to the extent permitted by applicable law. Failure to enforce a provision is not a waiver.
